Rogers E-mails CGO in Face of Consumer Backlash

Yesterday we ended being e-mailed twice by an employee at Rogers who seems to be the social media spin doctor for the company, trying to court our support. Below are the e-mails and responses to them:
First E-mail:

Hello Jason and Teresa,

As co-founders of the Canadian Gamers Organization, we would like to invite you to meet with us so that we can discuss your concerns with our Internet Traffic Management Policy and gaming in general. From Rogers, we would have a member of our network engineering team available to address your questions and can arrange a meeting at a time/place that is mutually agreed on with you.

We believe we share a common goal - to ensure all problems are fixed so gamers can have the best possible experience on our network. This would be a great opportunity to share information and learn from each other in a direct discussion. You are welcome to invite other members of your organization if you would like to.

If you would like to proceed with this meeting, please let me know and I’ll arrange details with you and our internal team.

Mary,

We appreciate the offer, but we are not satisfied that Rogers has put forth the proper testing needed to ensure compliance with CRTC policy when they should have. The responsibility of this testing lies directly with the developer of the software you use and with Rogers, and we are expecting this testing to take place without our help at this time.

Once we are satisfied that Rogers has put forth the necessary effort and testing to ensure compliance with CRTC policy we might reconsider, however any conversations we have with respect to adherence with CRTC policy and/or affected games, will have to conform with the new rules that will be put in place this week by the CRTC on ITMP complaints.

As stated in previous letters to the CRTC and Rogers, our position is that it's not the users responsibility to ensure compliance with CRTC policy on this matter. If Rogers deploy's ITMPs on its network, it is their sole responsibility to ensure those ITMPs conform with CRTC policy, not the end users.

Second E-mail:

Thanks for the swift response, Jason.

I appreciate your position on this and would like to extend this as an open invitation to you both, when you feel comfortable. But just so we’re clear, the intent was not to involve you in testing of any kind. It was merely an invitation to share information and get your thoughts/opinions on how we should engage customers in future. Also, we were hoping to discuss the creation of a Rogers Gamers Panel, intended to be an open forum between Rogers and our gaming influencers. Our intent is to proceed with the creation of this forum so if you’d like to be involved, it’s open to your discretion.

Again, appreciate your time and hope we will have the opportunity to work together in future.

Our Response:

Mary,

The issue here is with adherence to CRTC policy. We would only consider such an invitation once the orders from the CRTC are complied with and there is no possibility of misclassification of games or any other real time media.  I think your invitation here is premature, and targeting gamers only, when this misclassification issue could be and is affecting several other time sensitive operations by Rogers own admission.

Once Rogers is within compliance with CRTC policy, Teresa and I will discuss further whether or not to volunteer our time to this effort. Again we must stress that the users and gamers are not to be used to ensure compliance with CRTC policy.  We have seen nothing in this invitation that satisfies that request.

We also request at this time, that any further communications relating to this matter, be formally submitted to the CRTC and related to compliance with the current order and CRTC policy.  Teresa and I will contact you at the appropriate time should we want to accept such an offer.
